Judge Dismisses the Majority of Dan Rather's Lawsuit

Former CBS Evening News anchor Dan Rather's $70 million lawsuit against his former employers may still make it to court, but it won't be packing nearly as much punch.

Manhattan judge Ira Gammerman dismissed four of the seven claims made in Rather's lawsuit, particularly those that name Viacom chairman Sumner Redstone (Viacom is CBS' former parent company), CBS president Leslie Moonves and former CBS News president Andrew Heyward. Rather's lawsuit, which was filed in September, claimed that he was treated unfairly by CBS News after a September 2004 broadcast about the military service of President Bush in Vietnam was proven to be flawed. He also claimed his reputation in the final months of his contract was damaged because he was made a "scapegoat" in an effort to appease the Bush administration.

With the dismissal, the suit has now been boiled down to a garden-variety contract dispute. With all of the sensational political accusations and sought punitive damages dismissed, the remainder of the case hinges on whether CBS honored its contractual obligations to Rather (airtime on 60 Minutes) after his departure from the nightly telecast.

The judge got it right. Dan Rather has been trying to make CBS responsible for his mistake and that of his production team. Family and friends told him the lawsuit would be thrown out and it was. It was without merit. Hopefully he can accept the judge's decision and move on with his life.

I think Rather is responsible for the damage to his reputation. He relied on staff and didn't double check their work and ended up putting his face on a story he didn't do the legwork on. He would have taken the acclaim and all the credit if things had gone smoothly. Only fair that he should accept the consequences for the shoddy reporting.

I think what really got his goat is that he knew he'd take the fall and was prepared to end his career at "60 Minutes", only CBS News thought his credibility was shot, so they didn't give him any assignments. In other words, they were willing to give him a desk and a paycheck, but they weren't all that excited about putting him on the air again. His pride was wounded and he couldn't accept the inevitable. So push came to shove and he was shown the door.

In the end, we'll never really know what happened with George W Bush's National Guard records and whether he completed his service or was given special treatment by receiving credit without putting in the time. Instead, we got a lot of back-and-forth over fake documents. W got re-elected and John Kerry got "swift-boated".
